I sell a device with a lithium battery. Does battery EPR apply?
Potentially yes. The Batteries Regulation expressly includes batteries incorporated in appliances and other products.
Must a foreign distance seller appoint an EPR authorised representative?
A producer covered by Article 3(47)(d) must appoint, by written mandate, an EPR authorised representative in each Member State where it sells batteries.
Does the representative take over every manufacturer obligation?
No. The mandate concerns the EPR tasks assigned under the applicable framework; product-conformity and other manufacturer duties remain separate.
